Certificates of Insurance for Agency Staff
Occasionally, facilities may obtain temporary employees from contract nursing agencies. These agencies provide licensed and unlicensed personnel on an "as needed" basis. Since the use of agency personnel does not permit a detailed timely investigation into the credentials and qualifications of each person by the nursing facility, a substantial amount of reliance is based on "pre-screening" by the contract nursing agency.
When forming a contract with these agencies, it's recommended that facilities require the agency to carry adequate malpractice insurance and include a clause promising to indemnify and hold harmless the nursing facility and it's corporation in the event that it suffers a loss due solely to the action of an agency staff member while functioning in the nursing facility. This will help reduce the risk of the facility and corporation having to assume an undue share of any prospective professional liability judgment or settlement.
